PishPoshPaints’ Policy Regarding Copyrighted Works All images on our site are either licensed or in the public domain because their copyright has expired. This applies to the United States, Canada, the European Union and those countries with a copyright term of life of the author plus 50 years. However, our database contains more than 500 images and mistakes do happen! If you find any image that you believe to be under copyright protection, please contact us and the image will be removed. PishPoshPaints, LLC respects copyright laws and any copyrighted image which is found in our database is immediately removed. In addition, faithful reproductions of two-dimensional original works cannot attract copyright in the U.S. according to the rule in Bridgeman Art Library vs. Corel Corp. For all portraits paintings as well as paintings on request, customers are both responsible and liable for the images they upload. PishPoshPaints, LLC paints derivative works on customers' behalf based on photographs provided by the customer or stock images of public domain artwork. Our paintings are not photographic reproductions and might differ from the original in size, signature, brushstrokes and other details. Responsibility to ensure that the image is in the public domain, use is within fair use provisions or that any copyright permissions required have been granted remains with the customer.

NOTIFICATION OF CLAIMS OF INFRINGEMENT

If you believe that your work has been copied in a way that constitutes Copyright infringement, or your intellectual property rights have been Otherwise violated, please notify our agent for notice of claims of Copyright or other intellectual property infringement ("Agent"), at info@pishposhpaints.com

Please provide our Agent with the following Notice:

a) Identify the material on our site that you claim is infringing, with enough detail so that we may locate it on the website;
b) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

Although PishPoshPaints, LLC is unable to control all of the images that our customers upload to the website we can and will refuse to make a painting from any photo that might harm or offend individuals of other religions, races, etc. Again, customers are both responsible and liable for the images they upload.?

You will indemnify us and hold us harmless, including our parent organization, subsidiaries, affiliates, officers and employees harmless, including costs, fees, damages and reasonable attorney’s fees, from any claim or demand made by any third party due to or arising out of your use of our tools or services and or any action you have taken relating to your use of our Web Site and the related tools and services.

PishPoshPaints, LLC reserves the right to change, add or remove any portion of these terms and conditions of use, in whole or in part, at any time. Changes in the terms and conditions of use will be effective when posted. You agree to review these terms and conditions of use periodically to make yourself aware of any changes.
